Miscarriage Of Justice In The Workplace

Don’t let a miscarriage of justice in the workplace go unnoticed. We are here to fight for your rights and ensure a fair outcome.

Miscarriage of justice

A miscarriage of justice occurs when the legal system fails to deliver a fair outcome, leading to wrongful convictions or acquittals. This can happen for a variety of reasons, such as errors in evidence handling, prosecutorial misconduct, or inadequate legal representation.

A miscarriage of justice undermines the very principles of fairness and equity that are supposed to guide the judicial system.

When an innocent person is convicted of a crime they did not commit, it’s not just a personal tragedy for the wrongfully accused; it also damages public trust in the legal system.

This issue is not just an abstract legal concept but a real and pressing problem that affects countless individuals and their families.

When the legal system wrongly convicts an innocent person, it has great effects that ripple through both an individual’s life and society at large.

At a personal level, the effects on the wrongfully convicted can be both devastating and long lasting. An individual who is found guilty for something they did not commit may face severe emotional trauma, including depression, anxiety, and post-traumatic stress disorder.

Being a “criminal” can stunt an individuals career growth or face obstacles for future employment opportunities. Furthermore, it can affect their personal and social lives.

This personal impact is not confined to the wrongfully convicted alone but extends to their families, who may also suffer from emotional distress, social isolation, and financial strain due to the legal battles and the loss of a family member’s income.

Post Office Horizon – Miscarriage of Justice:

The Post Office Horizon Scandal is the most widespread miscarriage of justice in British legal history.

Individuals that ran post offices in the UK were accused of false accounting, theft and embezzlement by reason of a faulty IT system called, Horizon. Over 900 post office operators were wrongfully accused and prosecuted.

Some of the individuals were sent to prison, others’ livelihoods and reputations were damaged; and their mental health and finances were affected.

19 people in Scotland asked for their convictions to be reviewed.

8 out of 19 were referred to court. 6 out of the 8 were cleared and 2 are waiting on an outcome.

1 out of 19 has been rejected and 3 are on hold.

Some individuals that were accused but not convicted received compensation and others are still waiting.

Some individuals that used their money to repay the losses caused by the faulty IT system are entitled to claim £75,000.

Others that passed on before the Horizon scandal were uncovered.

To date, 100 convictions have been quashed in the UK as a whole.

The Shrewbury 24 – Miscarriage of justice:

During the 1972 builders’ strike, 24 trade unionists were wrongfully convicted of violent disorder in a politically charged trial. The convictions were found to be influenced by political motivations rather than evidence of actual wrongdoing.

The Shrewsbury 24’s wrongful convictions were based on a campaign by the government to suppress workers’ rights and discredit trade unions. This case not only exemplifies how political interference can lead to miscarriages of justice but also underscores the need for an impartial and fair legal process for workers seeking to defend their rights.

The Shrewsbury 24 were eventually exonerated, and their case spurred calls for greater protections for workers and reforms to prevent similar injustices in the future.

“It’s taken unimaginable determination to ensure justice, finally, prevailed.” – Sir Keir Starmer, the Labour leader and UK Prime Minister.

Starmer also called it, “A hug victory”.
